Judge: Trump Can't Halt Funding For Military Sex Change Surgeries

A federal judge in Seattle says she'll decide by December 8 whether to join her counterparts in Washington, D.C., and Baltimore in blocking the Trump administration's proposed transgender military ban.

In his 53-page ruling, Garbis wrote that transgender servicemembers "demonstrated that they are already suffering harmful consequences such as the cancellation and postponements of surgeries, the stigma of being set apart as inherently unfit, facing the prospect of discharge and inability to commission as an officer, the inability to move forward with long-term medical plans, and the threat to their prospects of obtaining long-term assignments".

Garbis has ordered US military heads not to enforce policies and directives of Trump regarding military eligibility of transgender service members and related sex-reassignment medical procedures.

The preliminary injunction stops the president from kicking out transgender people now serving in the military, from barring the enlistment of transgender individuals, and from prohibiting transition-related surgery for service members. The order was a proposed reinstatement of a longstanding policy that barred transgender people from joining the military and also subjected service members to discharge if they were revealed to be transgender. "A capricious, arbitrary, and unqualified tweet of new policy does not trump the methodical and systematic review by military stakeholders qualified to understand the ramifications of policy changes".

The preliminary injunction prohibits the president's policies until the lawsuit is resolved. Two weeks before Trump issued his official memo instating the ban in late August, two LGBTQ organizations filed lawsuits against it.

"As directed by the DoD guidance, no action may be taken to involuntarily separate or discharge an otherwise qualified service member exclusively on the basis of a gender dysphoria diagnosis or transgender status", Wright said.
