Centre files affidavit in Supreme Court terming Rohingyas threat to national security

Estimates suggest close to 90,000 Rohingyas have fled from Myanmar to Bangladesh

The apex court had told the government to submit the affidavit after a plea was filed before it against the deportation of the illegal immigrants to Myanmar.

Arguing for deportation of Rohingyas, the government said the Rohingya influx began in 2012 and added that there are at present around 40,000 such refugees in the country.

Mukesh Mittal, a senior home ministry official, said the Supreme Court must let the government to take a decision in Indian interests because of Rohingya links to extremist groups.

"It is submitted that continuance of Rohingyas' illegal immigration into India and their continued stay in India, apart from being absolutely illegal, is found to be having serious national security ramifications and has serious security threats", it said.

The top court will hear the matter again on October 3. Minister of State for Home Affairs Kiren Rijiju had said they were illegal immigrants, even those registered with the United Nations High Commission for Refugees.

Moreover, since there was a "serious national security threat/concern", the government should be allowed to exercise its essential executive function by way of a policy decision to deport the Rohingyas in the larger interest of the nation, the affidavit said.

The affidavit was filed in response to a petition against the deportation of Rohingya Muslims from India.

Human Rights Watch urged India, the world's biggest democracy, to follow the worldwide principle of non-refoulement which prohibits sending back refugees to a place where their lives are in danger.

The government also claimed that many of these refugees had managed to acquire PAN cards using fake documents and it could put the nation in serious threat.

Three other people were taken to hospital to be treated for injuries, a refugee camp leader said. "I want to request the government not to send us back to Myanmar".

The ASG told the court that the government would place facts in detail which the Centre has been receiving for many years as well as other information concerning national security in a sealed cover only for the perusal of the court.

An estimated 40,000 Rohingyas are present across India, including in Jammu and Kashmir and Rajasthan states. "That the provisions of Convention Relating to the Status of Refugees, 1951 and Protocol Relating to the Status of Refugees, 1967 can not be relied upon by the petitioner since India is not a signatory of either of them".
